Recovering Fraud Losses, Tax Update, and the ABCs of Keeping CCPCs “Pure” for Minimizing Capital Gains
1. Income Tax Update
Joe Yukich will provide an update of the proposals based on the Department of Finance’s responses to submissions from the public, proposed changes to the draft legislation and any available published views from CRA on their interpretation and expected administrative enforcement of the proposals. His presentation will include a summary of Finance’s comments to the Canadian Tax Foundation at their September 25 all-day seminar on the proposals as well as any of their subsequent commentary.
Joe will also review any related pre-year-end planning that private companies and their shareholders should consider in light of the July 18 changes.
2. Recovering Fraud Losses
Joe Albert will discuss the process and strategies available for recovering fraud losses, from his unique experience as a CPA, Licensed Insolvency Trustee and Investigative and Forensic Accountant. Joe will discuss many of the specific remedies available such as Mareva Injunctions, Anton Pillar Orders and Certificates of Pending Litigation. He will also focus on the powerful investigative and recovery remedies available through the appointment of a Receiver or Trustee in Bankruptcy by court process.
